Participant Waiver & Release

By participating in this program, Parent/Caregiver on behalf of any participant acknowledges that this voluntary activity may involve flexibility, strength, aerobic, cardio, and other exercises, all of which may be potentially hazardous. Parent/Caregiver, on behalf of participant, hereby agrees to expressly assume and accept any and all risks of injury and to forever waive, release, discharge, and hold harmless A/R Retail, LLC, The Related Companies, L.P, together with each of their affiliates and each of their respective partners, members, managers, directors, officers, shareholders, principals, boards, employees and agents, and their respective successors and assigns from any and all liability, damages, losses, suits, demands, causes of action (including, without limitation, negligence), expenses (including attorneys’ fees or medical expenses) or any other claims of any nature whatsoever, including, without limitation, any losses for property damage, personal injury or death, arising out of or relating to participation in the program and activities or the use of any facilities, equipment or machinery in connection with the program, except to the extent of the willful misconduct or gross negligent acts or omissions of any of the Released Parties.
